Terms of Service

These Terms constitute a legally binding agreement under the Information Technology Act, 2000 and the Indian Contract Act, 1872. By registering or using Senduta, you confirm that you are at least 18 years of age and legally competent to enter into this agreement.
1. Definitions
- "Service" — the Senduta platform accessible at senduta.com
- "User" / "Data Principal" — any individual who registers and uses the Service
- "Document" — any file uploaded by a User for delivery via the Service
- "Delivery Certificate" — an electronically generated document evidencing proof of delivery, constituting an electronic record under Section 2(1)(t) of the IT Act, 2000
- "Intermediary" — Senduta in its capacity as an intermediary under Section 2(1)(w) of the IT Act, 2000
2. Nature of Service — Intermediary Status
Senduta operates as an intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000. In accordance with Section 79 of the IT Act and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021:
- Senduta does not initiate or modify the content of documents transmitted through the Service
- Senduta shall not be liable for any third-party information, data, or communication links hosted on the platform
- Senduta will take down content upon receipt of a court order or notification from an appropriate government authority
- Senduta will cooperate with law enforcement agencies in accordance with applicable Indian law
3. Electronic Records & Contracts
All transactions, agreements, notices, and communications conducted through Senduta constitute valid electronic records under Section 2(1)(t) of the Information Technology Act, 2000, and are enforceable as electronic contracts under Sections 10A of the IT Act read with Sections 3–9 of the Indian Contract Act, 1872.
Delivery certificates generated by Senduta constitute electronic records admissible as evidence under Sections 65A and 65B of the Indian Evidence Act, 1872, subject to compliance with the certification requirements thereunder.
4. Acceptable Use
You agree not to use Senduta to upload, transmit, or share:
- Content that is obscene, defamatory, or violates any law under the Indian Penal Code, 1860 or the IT Act, 2000
- Material that infringes intellectual property rights under the Copyright Act, 1957 or Trade Marks Act, 1999
- Content that threatens national security or public order as defined under IT Act Section 69A
- Unauthorized personal data of third parties in violation of the Digital Personal Data Protection Act, 2023
- Content that constitutes cheating, fraud, or impersonation under the IPC or IT Act
- Malware, spyware, or any harmful code as prohibited under IT Act Sections 43 and 66
Violations may be reported to law enforcement under applicable provisions of the IT Act, IPC, and DPDP Act 2023.
5. Data Security Obligations
Senduta implements reasonable security practices as mandated by Section 43A of the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (SPDI Rules).
In the event of a data breach affecting Sensitive Personal Data or Information (SPDI), Senduta shall notify affected users and the relevant authorities as required under applicable law, including obligations under the DPDP Act, 2023.
6. Billing, Taxes & GST
All prices displayed are exclusive of applicable taxes. Goods and Services Tax (GST) will be charged at the prevailing rate as per the Central Goods and Services Tax Act, 2017 and Integrated Goods and Services Tax Act, 2017. A GST-compliant invoice will be issued for all paid transactions upon request.
Payment processing complies with the Payment and Settlement Systems Act, 2007 and applicable RBI guidelines on digital payments.
7. Consumer Rights
Users who are consumers as defined under the Consumer Protection Act, 2019 are entitled to the rights and remedies provided thereunder, including the right to seek redressal through the Consumer Disputes Redressal Commission. Nothing in these Terms limits your statutory consumer rights.
In case of a complaint, you may also approach the Consumer Helpline at 1800-11-4000 or file a complaint at consumerhelpline.gov.in.
8. Grievance Redressal
In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Senduta has appointed a Grievance Officer:

9. Intellectual Property
The Senduta platform, brand, and all associated software are protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You retain full ownership of all documents you upload. By uploading, you grant Senduta a limited, non-exclusive licence to store, process, and transmit your documents solely for the purpose of providing the Service.
10. Limitation of Liability
To the maximum extent permitted under Indian law, Senduta's aggregate liability for any claim arising out of or relating to the Service shall not exceed the total fees paid by you in the three months preceding the claim. This limitation does not apply to liability arising from gross negligence, wilful misconduct, or fraud.
Senduta shall not be liable for any indirect, consequential, or punitive damages, including loss of profits or data, except where mandated by law (including liability under Section 43A of the IT Act).
11. Dispute Resolution
The parties shall first attempt to resolve any dispute through good-faith negotiation. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration at Chennai, Tamil Nadu. The arbitration shall be conducted in English by a sole arbitrator mutually agreed upon by the parties.
Nothing herein prevents either party from seeking urgent interim relief from a court of competent jurisdiction.
12. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Subject to the arbitration clause above, the courts at Chennai, Tamil Nadu shall have exclusive jurisdiction over any disputes arising from or relating to these Terms or the Service.
13. Modifications
Senduta reserves the right to amend these Terms at any time. Material changes will be communicated via registered email at least 15 days prior to the effective date. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
